This is the Fresh Queen 鮮后 (FreshQueen) Privacy Policy. FRESH QUEEN collects, uses and discloses Customer Datain order to provide you with a safe, smooth, efficient and customisedexperience with FRESH QUEEN. The collection, use and disclosure of CustomerData enables FRESH QUEEN to provide services and products that are most likelyto meet your needs and requirements. This Privacy Policy outlines FRESH QUEEN’spolicy and responsibility in relation to the collection, use and disclosure ofCustomer Data.

Bycontinuing to use FRESH QUEEN’s services, you signify that you have read,understood and agree to be bound by this Privacy Policy as amended from time totime in respect of FRESH QUEEN’s collection, use and disclosure of yourCustomer Data.

ThisPrivacy Policy is divided into two Parts – A and B:

· PartA: General Customer Data privacy policy statement

· PartB: Privacy policy statement for Customer Data collected through FRESH QUEEN’swebsites and FRESH QUEEN’s mobile services facility

PartA: General Customer Data privacy policy statement

1.Types of Customer Data
The types of Customer Data that FRESH QUEEN collectsdepends on the circumstances of collection and on the nature of the servicerequested or transaction undertaken.

Thereare two broad categories of Customer Data that FRESH QUEEN collects dependingon the circumstances:

· PersonalData, which includes but is not limited to -

(i)personal information that links back to an individual e.g., name, gender, dateof birth, passport or other personal identification numbers;

(ii)contact information e.g., address, phone number, email address;

(iii)payment information e.g., credit or debit card information, including the nameof cardholder, card number, billing address and expiry date;

(iv)order information e.g., order information, product purchased or other servicepreferences;

(v)technical information e.g., IP address; and

· StatisticalData e.g., number of orders, visits to website. This is stored purely foranalytical purposes, and is entirely anonymous. This information will not bestored to your customer record, and will only be aggregated for statisticalanalysis so that we can better understand FRESH QUEEN's customer profile andimprove FRESH QUEEN's service offering.

Forpurposes of this policy statement, the phrase Customer Data includes PersonalData and Statistical Data.

Theprovision of Customer Data relevant for the transaction or service request athand, (save for where the request for data is marked “optional” in the formsused to collect personal data) is obligatory in order for FRESH QUEEN to carryout its services to you.

Thefailure to supply such Customer Data may result in (i) FRESH QUEEN being unableto provide you with the services and/or products requested; (ii) FRESH QUEENbeing unable to update you on our latest products and/or launches; and/or (iii)your inability to enter or participate in contests, promotions or redemptionactivities organised by FRESH QUEEN.

2. Purposes for Collection, Use and Disclosure
Generally, FRESH QUEEN collects Customer Data, eitherdirectly from you or from your authorised representatives (i.e. persons whomyou have authorised, persons who have been validly identified as being you oryour authorised representative pursuant to our then-current securityprocedures), from third parties (e.g., our service provider), or from publiclyavailable sources, through our website, mobile services, and other channelsincluding our roadshow counters in order to fulfil the following purposes,which include but are not limited to:

· Providingservices to you such as processing a transaction (e.g., making a purchase),providing technical assistance, assisting you in the transaction, providingpromotion alert messages through FRESH QUEEN’s mobile services facility,facilitating internet purchases and registering for FRESH QUEEN’s programme;

· Providingin-store services and other services that best meet your preferences and needs(which we may collect during our interactions with you);

· Marketingand communicating with you in relation to products and services offered by FRESHQUEEN, FRESH QUEEN’s service partners, as well as FRESH QUEEN’s appointedagents;

· Contactingyou for product or customer satisfaction FRESH QUEEN and market research; and

· Safety,security and legal compliance.

FRESHQUEEN may also use and disclose your Customer Data with and to third parties inorder to fulfill the purposes listed above.

Inconnection with the above, we may disclose your Customer Data to third parties,such as our freight service providers and logistics partners.

FRESHQUEEN may also use and disclose your Customer Data to persons who have beenvalidly identified as being you or your authorised representative(s) pursuantto our then-current security procedures, for the purpose of the relevanttransaction or enquiry.

FRESHQUEEN shall use its best endeavours to ensure that its employees, officers,agents, consultants, contractors and such other third parties mentioned abovewho are involved in the collection, use and disclosure of Customer Data willobserve and adhere to the terms of this Privacy Policy.
FRESH QUEEN may disclose your Customer Data to lawenforcement agencies and government for security, customs purposes. Forexample, in cases where you send a product from FRESH QUEEN to family andfriends overseas.

Inaddition, FRESH QUEEN may disclose Customer Data to our legal advisors forestablishing, exercising or defending our legal rights, to our otherprofessional advisors, or as otherwise authorised or required by law. FRESHQUEEN also reserves the right to share Customer Data as is necessary to preventa threat to the life, health or security of an individual. Further, FRESH QUEENmay disclose Customer Data, as is necessary, to investigate suspected unlawfulactivities including but not limited to fraud, intellectual propertyinfringement or privacy.

3.Transfer of information overseas
The FRESH QUEEN Head Office is based in Singapore. CustomerData may be transmitted to data storage facilities where FRESH QUEEN keeps itscentral records or for backup purpose. Customer Data may be transferred to FRESHQUEEN’s offices and appointed agents in Singapore or other countries inconnection with FRESH QUEEN’s performance of the contract with you.

4.Consent
Generally, in the course of making a purchase at FRESHQUEEN or FRESH QUEEN performing servicing functions such as processing yourorder, helping you with membership registration, transmitting promotion alertmessages or accepting payment information, Customer Data will, by nature of thetask or transaction, be provided by Customer to FRESH QUEEN. In such instances,consent will necessarily be implied from the Customer that they are agreeableto providing Customer Data in order for FRESH QUEEN to provide the requested ornecessary service and/or product to them. However, where required by law,FRESH QUEEN will adopt an ‘opt-in' policy for obtaining customer consent, inwhich event, express written consent will be sought from you when collectingyour Customer Data e.g., signing a form or checking a box. Where you make purchaseson behalf of another person, you undertake and will ensure that the individualwhose Customer Data is supplied to FRESH QUEEN has authorized the disclosure,is informed of and consents to the terms and conditions of this Privacy Policy.

Youmay submit a request to withdraw your consent at any time by contacting FRESHQUEEN (see Section 10) or by logging on to your website account with FRESHQUEEN (if you are a Fresh Queen member or a non-Fresh Queen member registeredas a user of FRESH QUEEN’s websites).

StatisticalData is not linked to a customer record and FRESH QUEEN does not need to seekconsent for the collection, use or disclosure of Statistical Data. For moreinformation on the collection and usage of Customer Data obtained from FRESHQUEEN’s websites and through FRESH QUEEN’s mobile services facility, pleaserefer to Part B.

5.Access
FRESH QUEEN will, upon your written request to our PersonalData Protection Officer (see Section 10), allow you to access your storedPersonal Data. Where permitted by law, FRESH QUEEN reserves the right to chargea reasonable administrative fee for this service. Where permitted by law, FRESHQUEEN reserves the right to deny you access to your Personal Data and mayprovide an explanation.

6.Retention
FRESH QUEENwill retain Customer Data for as long as it is necessary to fulfill the purposefor which it was collected, the legal or business purposes of FRESH QUEEN, oras required by relevant laws.
When destroying Customer Data, we will take commerciallyreasonable and technically possible measures to make the personal informationirrecoverable or irreproducible in accordance with the applicable laws.

7.Accuracy
FRESH QUEEN needs your assistance to ensure that yourPersonal Data is current, complete and accurate. As such, please inform FRESHQUEEN of changes to your Personal Data by contacting FRESH QUEEN and submittingyour updated particulars to FRESH QUEEN in writing (see Section 10).

FRESHQUEEN may also request Personal Data updates from you from time to time. Asdetailed in Section 2 above under the “Use and Disclosure” sub-section, yourorder information may be disclosed to the appropriate customs and immigrationauthorities (for overseas purchases) as required by law. As such, it isimportant to ensure that the Personal Data contained in your order informationis current, complete and accurate.

8.Security safeguards
FRESH QUEEN takes the security and protection of yourCustomer Data very seriously. As such, FRESH QUEEN makes reasonable securityarrangements to protect your Customer Data against loss or theft as well asunauthorised access and undue disclosure.

Asan example of a procedural safeguard, FRESH QUEEN has implemented variousauthentication procedures internally and with our external service providersthat may involve FRESH QUEEN requesting various personal particulars from youin order to verify your identity (or that of your duly authorised agent) beforeFRESH QUEEN processes your request for a particular service, product ortransaction.

Examplesof technical safeguards include encryption, “firewalls” and Secure Socket Layer(SSL). Further details of these technical safeguards for Customer Data collectedthrough FRESH QUEEN’s websites and FRESH QUEEN’s mobile services facility areset out at Part B below.

If,however, a customer does not take reasonable care to ensure the continuedconfidentiality and accuracy of their Customer Data, FRESH QUEEN will not beliable for any consequential misuse and/or fraud. If you have any concernsabout security, you should contact FRESH QUEEN (see Section 10).

9.Updates to the privacy policy
FRESH QUEEN will amend this Privacy Policy from time totime and the updated versions will be posted on FRESH QUEEN’s website and datestamped so that you are aware of when the Privacy Policy was last updated.Subject to applicable laws, the English version of this Privacy Policy willprevail over any version of this Privacy Policy in another language. In theevent of any inconsistency in interpretation between the English version andany translation of the Privacy Policy, this Privacy Policy statement in Englishwill prevail.

PartB: Privacy policy statement for Customer Data collected through our websitesand our mobile services facility

1.Security safeguards
FRESH QUEEN takes the protection of your Customer Datacollected on FRESH QUEEN’s websites and through FRESH QUEEN’s mobile servicesfacility very seriously. All Customer Data collected through FRESH QUEEN’swebsites, e.g., http://www.freshqueenhk.com and through FRESH QUEEN’smobile services facility are protected by a secure server. In addition, SSL(Secure Socket Layer) protects the transmission of data from the internet toour systems.

For example, when you transmit sensitive information such ascredit card details through FRESH QUEEN’s websites, such information will beencrypted before being dispatched over the internet.

Tofurther strengthen the integrity of your internet transactions on our websites,FRESH QUEEN also employs relevant software programs to monitor network trafficwith a view to identifying unauthorised attempts to upload or change CustomerData, perpetuate fraudulent or illegal activities or otherwise cause damage. Ifsuch monitoring reveals evidence of possible abuse or criminal activities, suchevidence may be provided to appropriate law enforcement authorities or agencieswithout notice to you.

Togive you secure access to our online services, arising from your utilisation ofFRESH QUEEN’s mobile services facility, and your Fresh Queen account, you canregister with us, and we will give you a membership number/ User ID with a PINthat is unique and personal to you. You should not share your membershipnumber/User ID or PIN, and should always ‘log off' once you have finished yoursession on the websites as well as take the recommended precautions that ensurethe safe and secure provision of FRESH QUEEN’s mobile services facility.

Asan additional security feature, FRESH QUEEN has implemented a time stampshowing the time you have been on FRESH QUEEN’s websites and the last time youlogged out. If you detect any anomalies you should inform FRESH QUEENimmediately.

2.Cookies
Most websites like ours use cookies to enhance your onlineexperience. A cookie is a small string of information that the website that youvisit transfers to your computer for identification purposes. Cookies can beused to follow your activity on the website and that information helps us tounderstand your preferences and improve your website experience. FRESH QUEEN provides you with links to other websites foryour convenience and information. You access these websites at your own riskand FRESH QUEEN is not responsible for these websites. Whilst FRESH QUEEN willprotect your Customer Data on FRESH QUEEN websites, FRESH QUEEN cannot controlor be responsible for the policies of other sites we may link to, or the use ofany Customer Data you may share with them. Please note that the FRESHQUEEN Privacy Policy does not cover these other websites, and FRESH QUEEN wouldrecommend that you are apprised of their specific policies.

5.Minors
FRESH QUEEN cannot distinguish the age of persons whoaccess and use its websites. If a minor (according to applicable laws) hasprovided FRESH QUEEN with Customer Data without parental or guardian consent,the parent or guardian should contact FRESH QUEEN to remove the relevantCustomer Data and unsubscribe the minor.

6. Google Analytics
Google Analytics is a web analysis service provided byGoogle. Google utilizes the data collected to track and examine the use ofwww.foodsport.com.hk, to prepare reports on its activities and share them withother Google services.
